The Management Board of Lubelski Węgiel BOGDANKA S.A. (the “Company”) hereby announces that on 5 August 2011 it became aware of bringing an action to the Regional Court in Lublin, IX Commercial Division by a member of the Company’s Supervisory Board elected by the employees, against the Company, to declare invalidity of resolution No. 32 of the Annual General Shareholders Meeting of 10 May 2011, regarding amendments to the Articles of Association.

The amendments referred to above are attached hereto.
